White v. W&B Client

Plaintiff alleged neurocognitive impairment caused by exposure to lead paint. Claims against W&B Client included negligence, violations of the Baltimore City Housing Code and Consumer Protection Act and negligent and intentional misrepresentation. A Baltimore City jury returned a defense verdict on all counts.

Thomas v. W&B Client

Defense verdict obtained in a Baltimore City lead poisoning case where Plaintiff asserted his lead poisoning was caused by residing in a property which was remediated pursuant to a research study protocol.

Jones v. W&B Client

Plaintiff claimed he was lead poisoned as a result of residing in a property allegedly recommended by a W&B Client. A Baltimore City jury returned a defense verdict following a four-week trial.

Harris v. W&B Client

Plaintiff claimed injury from exposure to lead paint at his residence during his participation in a research study. We disagreed and demonstrated any injury was caused by exposure to lead at a neighboring property. A six-week trial resulted in a defense verdict from a Baltimore City jury.

Partlow v. W&B Client

Summary judgment granted on all counts of this lead paint case, obviating the need for trial and resulting in considerable cost savings to our W&B Client.

Wrongful Birth Cases

We recently resolved two wrongful birth cases, one involving a prenatal ultrasound and the other involving genetic screening. In both cases, the child had had catastrophic damages. Each case raised a myriad of legal, ethical and medical issues. In the end, these cases were successfully resolved and the clients were very satisfied with the results.

Davis v. Podiatrist

Successfully defended podiatrist in jury trial involving alleged failure to properly perform Lapidus arthrodesis and Weil osteotomy, leading to alleged need for further surgery and permanent disability.

Szyjka v. Hospital, et. al.

Successfully defended Hospital client in a case alleging failure to timely diagnose and treat a brain tumor. The matter was tried in the United States District Court for the District of Maryland. Trial verdict was in favor of the Defendants.

Jones v. Hospital

Medical malpractice jury trial in the Circuit Court for Baltimore City involving an alleged failure to timely consult a neurologist to administer a bolus of Dilantin resulting in a seizure and death. The Hospital?s Motion for Directed Verdict was granted at the close of the Plaintiff?s case.

Bolfar v. Ophthalmologist, M.D.

Medical malpractice jury trial in the Circuit Court for Baltimore City. Allegations included negligent cataract extraction resulting in permanent left eye blindness. Jury verdict for Defendant.

Cataneo v. Ophthalmologist, M.D.

Medical malpractice jury trial in the Circuit Court for Baltimore County. Allegations included LASIK surgery causing retinal detachment several weeks post surgery. Jury verdict for Defendant.

Believed to be only LASIK jury trial defense verdict in Maryland.

Crawford v. Neurologist, M.D.

Medical malpractice jury trial in the Circuit Court for Prince George’s County. Allegations included inappropriate diagnosis of complex partial seizure disorder and prescription of Tegretol. Jury verdict for Defendant, ultimately affirmed by the Court of Appeals.

Edmonds v. Hospital

Obstetrical malpractice/nurse midwifery case (shoulder dystocia) tried for two weeks before jury in Baltimore City.

Fritz v. Otolaryngologist, M.D.

Medical malpractice jury trial in the Circuit Court for Anne Arundel County. Allegations include failure to perform appropriately an ethmoidectomy resulting in brain damage to the Plaintiff. Defense verdict.

Tucker v. Urologist, M.D.

Medical malpractice jury trial in Baltimore City involving surgical complications following a penile prosthesis. Verdict for the Defendant, the former Past-President of the Maryland Urological Society.

Madhiraju v. Orthopedist, M.D.

Medical malpractice jury trial in Circuit Court for Baltimore County. Allegations included failure to diagnose timely and appropriately treat a dislocated prosthesis with sciatic nerve involvement. Defense verdict.

Kiffney v. Pediatrician, M.D.

Medical malpractice orthopedic trial involving diagnosis and treatment of a fractured femur. Defense verdict. Tried in Harford County. Case appealed to appellate level and affirmed.

Conway v. Orthopedist, M.D.

Orthopedic case involving multiple surgeries to olecranon joint. Tried before jury in Baltimore City. Resolved after five days of trial at dollar figure less than pre-trial offer.

Dental malpractice case. Defense verdict. Prince George’s County.

Kiskis v. Anesthesiologist, M.D.

Two-week Federal Court medical malpractice case involving allegations of cauda equina syndrome caused by epidural anesthesia during child birth against Plaintiff’s attorney, Marvin Ellin. Jury verdict for anesthesiologist.

Kaplan v. Rupert

Epileptic seizure prior to rear-end collision. Circuit Court for Baltimore County. Jury verdict for Defendant.

Evers v. Urologist, M.D.

Alleged inappropriate conduct between patient/co-worker of urologist. Tried to defense verdict in Baltimore County before a jury.

Franklin v. Dentist, D.D.S.

Abuse of nitrous oxide by patient and dentist – alleged brain damage. Defense verdict for dentists in Baltimore County before a jury.

Patient v. Hospital

Resolved per confidentiality agreement, multi-million dollar medical malpractice claim involving administration of alleged contraindicated anesthetic agents causing brain damage. Baltimore City.

Carter v. Hospital

Successfully defended hospital in wrongful death of infant after ER visit and pneumonia diagnosis.

Allen v. Podiatrist, D.P.M.

Successfully defended podiatrist in Federal Court jury trial involving alleged failure to diagnose post-operative MRSA infection leading to great toe amputation.

Jackson v. Hospital

Medical malpractice wrongful death jury trial in the Circuit Court for Baltimore County. Allegations included failure to diagnose and treat timely a fatal pulmonary embolism after trauma. Defense verdict.

Alston v. Hematologist, M.D.

Medical malpractice wrongful death jury trial in the Circuit Court for Baltimore City. Allegations included failure to diagnose and treat a blood disorder known as TTP, an extremely rare blood condition.
